Social Security Disability Benefits and HIV
If you have been diagnosed with human immunodeficiency virus (HIV) and are unable to continue working due to the infection itself or the treatment you're receiving for it, our attorneys can help.
At Shifrin Newman Smith Inc., we have the experience, knowledge and resources it will take to help you succeed. We have been dedicated to this work since 1985 and have helped many people with HIV to obtain disability benefits. We also know that Social Security disability benefits may not cover all of your needs, and may be able to put you in touch with free or low-cost medical service providers as well as other organizations offering support or services in your area.
Find out for yourself what we can do to help you. The consultation is free; there are no attorney fees to pay unless we win. Call 877-230-5500 or contact us online.
Help your own cause. If you have a HIV, it is especially important that you establish a detailed history of regular medical care, blood work and treatment. You should also avoid engaging in any activities that are likely to aggravate your condition. We can help by working with you and your doctor, gathering the necessary medical evidence and even by covering the medical records fee if you can't afford it.
Symptoms of HIV
Although the diagnosis of HIV or even AIDS will not usually result in a finding of disability on its own, the physical and neurological effects of the virus — as well as the effects of the medications used to treat it — can qualify you as legally disabled.
In most cases, however, claims are denied unless a secondary infection is also present. Sections 14.00 (adults) and 114.00 (children) list a number of known HIV and AIDS-related conditions, including:
- Bacterial infections
- Fungal infections
- Protozoan or helminthic infections
- Viral infections
- HIV encephalopathy
- HIV wasting syndrome
