How the SSD appeals process works

It starts, of course, with the initial application, hearing and review process. After your initial application is denied, here's what happens:

  1. Reconsideration: You have 60 days to submit a request for reconsideration. The decision takes between 45 days and six months. If you are denied, you can request an administrative hearing.
  2. Administrative hearing: Here, you get a chance to plead your case before an actual administrative law judge. But you may have to wait for more than two years before your hearing! It's critical to have all the medical evidence in order. The judge's decision will come within two to eight months.
  3. SSA Appeals Council: If you lost in the hearing, you can submit a written appeal to the Social Security Administration's Appeals Council. If the appeal is approved, your case goes back to the administrative law judge for a review. We write the appeal for you. And a decision takes between six and 16 months.
  4. Federal court appeal: If your appeal is denied, you have 60 days to file an appeal in federal district court. The judge in this appeal can award benefits, send you back to the administrative law judge or deny your claim. The case takes between 18 and 30 months after filing.
